Terms of Service

These Terms of Service ("Terms") govern your access to and use of LamellaStudio's parametric design platform and services. By accessing or using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using LamellaStudio, you confirm that you are at least 18 years old (or the age of majority in your jurisdiction) and have the legal capacity to enter into these Terms. If you are using our services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Services

LamellaStudio provides a parametric design platform for creating lamella-based structures including ceilings, walls, facades, and other architectural elements. Our services include:

  • Real-time 3D design and preview tools
  • Parametric generation of lamella structures
  • Export of production-ready files (DXF, PDF, etc.)
  • Material specifications and assembly guides

3. User Accounts

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use
  • Providing accurate and complete registration information

We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for extended periods.

4. Subscription and Payment

Paid plans are billed in advance on a monthly or annual basis. By selecting a paid plan, you authorize us to charge your payment method for the applicable fees.

  • All fees are non-refundable except as described in our Refund Policy
  • We may change pricing with 30 days notice
  • Failed payments may result in service suspension
  • Annual plans are billed as a single payment for the year

5. Cryptocurrency Payments

We accept cryptocurrency payments processed through NOWPayments. By paying with cryptocurrency, you acknowledge and agree that:

  • Cryptocurrency transactions are irreversible once confirmed on the blockchain
  • You are responsible for sending the correct amount to the correct wallet address
  • Exchange rate fluctuations between the time of payment initiation and confirmation are your responsibility
  • Overpayments or underpayments due to network fees or exchange rate changes may not be recoverable
  • Payment confirmation times depend on the blockchain network and may vary
  • Your subscription will be activated upon confirmed receipt of payment

Refunds for cryptocurrency payments are subject to the terms described in our Refund Policy.

6. Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation:

  • Your access continues until the end of the current billing period
  • No refunds are provided for partial periods
  • You may export your data before the subscription ends
  • Project data may be deleted after a retention period

7. Intellectual Property

Your Content: You retain all rights to designs, heightmaps, and other content you create or upload. By using our services, you grant us a limited license to process and display your content as necessary to provide our services.

Our Platform: LamellaStudio and its original content, features, and functionality are owned by us and protected by international copyright, trademark, and other intellectual property laws.

Exported Files: You own all rights to the DXF, PDF, and other files generated from your designs. You may use these files for any purpose, including commercial fabrication.

8. Acceptable Use

You agree not to:

  • Use our services for any unlawful purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt our services
  • Reverse engineer or decompile our software
  • Share your account with unauthorized users
  • Resell or redistribute our services without permission
  • Upload malicious content or files

9. Disclaimers

Our services are provided "as is" without warranties of any kind, either express or implied. We do not warrant that:

  • Our services will be uninterrupted or error-free
  • Generated designs will be suitable for your specific application
  • Structural calculations are certified for construction

Important: LamellaStudio provides design tools and engineering estimates. For structures exceeding 200kg or in regulated applications, you must consult a licensed structural engineer.

10. Limitation of Liability

To the maximum extent permitted by law, LamellaStudio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of our services.

Our total liability for any claims arising from these Terms or your use of our services shall not exceed the amount you paid us in the twelve months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless LamellaStudio and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services or violation of these Terms.

12. Modifications to Terms

We may modify these Terms at any time. We will provide notice of material changes by email or through our platform. Your continued use of our services after such notice constitutes acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which LamellaStudio is incorporated, without regard to conflict of law principles.

14. Dispute Resolution

Any disputes arising from these Terms or your use of our services shall be resolved through binding arbitration, except where prohibited by law. You agree to waive any right to participate in class action lawsuits.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
